Writing Terms For A Jewelry Business

What exactly are terms and how would I write them? I went to a large jewelry business and looked at their privacy policy and terms and conditions and what I found all centered around privacy and credit card use. Didn't apply much to me. Or maybe it does and I'm just not understanding? Any help in this area would be appreciated. Thanks!

Hi Theresa. I would look at it as two separate things.

1) Privacy policy. This is about your visitors personal information and how it is going to be used. My favorite tool for this is from DMA and it walks you through a series of questions to generate the text you need.

2) Terms of service. This is about your visitors making a purchase and what they should expect. For example ... any guarantees, return policies, shipping terms, credit card refunds, etc. For this one, I would search google or another search engine for [jewelry and terms of service]. Get an idea what others are doing, then customize one for your site based on your purchasing policies.

Theresa, I think - like you - some customers will be confused by the terminology "terms of service". I would break the information up and create pages for "shipping", "privacy polic" and "return policy".

I would definately recommend splitting up your privacy policy (which is required by law) and your TOS (which is not, but is definately strongly recommended).

The privacy policy describes the type of information that you collect and how you use that information. There are certain requirements in privacy policies that must be met.

The terms of service is the "contract" between you and the users of your site.

I would strongly suggest that you use an attorney who is familar with all of these issues to draft these for you and to customize them to fit your particular situation. I have actually laid out the reasons why it makes sense to have them written professionally in my blog if you want more information.

I have re-written and updated my "Terms of Use" But I think - at the bottom of the page that "Terms of Use" should actually be "Terms of Service"? And then I did separate sections for each topic. Will this work for now? Anything I should add, take away, clarify? Thanks!
